Pursuant to terms of Judgment in the Trigg Circuit Court, the Commissioner will sell real estate, THURSDAY, March 18th, 2021, at public auction to the highest bidder. Auctioneer, Michael Dale Harris, will be employed to sell and procure a purchaser for the following described real estate at and auction at the site of the property described in the following actions:

 

FNB BANK, INC., PLAINTIFF, against SME AUTO PARTS, INC., STEVEN EZELL,

CRYSTAL EZELL, EDWARD F. JOINER, BARBARA D. JOINER, WAYPOINT BANK,

SANTANDER CONSUMER FINANCE USA, INC., BANK OF CADIZ & TRUST

COMPANY, AND COMMONWEALTH OF KENTUCKY, DEFENDANTS,

 

By virtue of a Judgment and Order of Sale of the Trigg Circuit Court, rendered on December 10, 2020, in the above action, I shall proceed to offer for sale at the locations mentioned below, in Cadiz, Trigg County, Kentucky, to the highest bidder at public auction on March 18, 2021, upon a credit of 10% of the sale price on day of sale, balance in 30 days, the following described real estate situated at 1969 Main Street, Parcel Identification No.: 194831. Cadiz, Trigg County, Kentucky, 3948 Linton Road, Parcel Identification No.: 194829, Cadiz, Trigg County, Kentucky, 3957 Linton Road, Parcel Identification No.: 194830, Cadiz, Trigg, County, Kentucky. The judgment in this case is to FNB Bank for $417,247.32 in principal and interest of $10,723.67; plus interest at the rate of $95.69 per day from the date of judgment until paid FNB Bank and to Bank of Cadiz in the amount of $1,709.47 plus interest at the daily rate of $0.37 from the date of judgment until paid. For the balance of the purchase price, the purchaser must execute bond with approved surety or sureties, having the force and effect of a judgment. Provided there are sufficient funds, delinquent ad valorem taxes assessed against the real estate shall be paid from the proceeds of the sale. The property taxes for the year 2021, and later shall be paid by the purchaser. The property is sold subject to: real estate taxes affecting said real estate for the current tax year and all subsequent taxes. There is a right of redemption for the defendants if the property does not bring two thirds (2/3) of its appraised value. Bidders will be prepared to comply promptly with these terms. Any announcements made on date of sale take precedence over printed matter contained herein. Health and safety measures to include social distancing and the use of facial coverings over the nose and mouth will be required at sales.
