These Terms & Conditions apply to all auctions conducted by Harris Real Estate & Auction, whether live, online, or simulcast. By registering, bidding, or attending any auction event, you agree to be bound by all terms listed below.
1. Buyer’s Premium & Payment
A 20% Buyer’s Premium is added to all winning bids to determine the final purchase price.
Payment Deadline: All invoices must be paid in full prior to pickup and by the date specified on the auction advertisement.
Accepted Payment Methods: Cash, Wire Transfer, Cashier’s Check, Money Order, and Credit Card.
A 3% processing fee applies to all credit card payments.
Invoices over $2,000 may not be paid by credit card.
Unless prior arrangements are approved, the credit card registered with Hibid will be charged automatically following the auction.
A $25 “No-Show” fee may be charged if payment is not received by the pickup deadline.
All sales are final. No refunds, returns, or exchanges.
2. Auctioneer’s Rights & Discretion
Harris Real Estate & Auction reserves the right to add, delete, edit, combine, subdivide, or re-catalog lots at any time before auction close.
Sale dates, times, or procedures may be changed in the event of technical issues, weather, or emergencies.
The auctioneer reserves the right to accept or reject any bid at their discretion.
Employees and associates of Harris Real Estate & Auction may bid for themselves or on behalf of absentee/proxy bidders.
All accepted bids constitute a legally binding contract between the bidder and the seller.
All lots are sold subject to seller confirmation, unless specifically announced as Absolute.
3. Pickup, Loading & Removal
Items must be paid in full before pickup.
Pickup must occur on the date and time stated in the auction details.
Buyers are solely responsible for rigging, dismantling, loading, securing, transporting, and unloading their purchases.
Harris Real Estate & Auction does not provide labor or equipment for loading and assumes no liability for injuries, damages, or losses during removal.
Buyers must verify that all purchased items are present before leaving the pickup location.
Items left behind are considered abandoned and forfeited without refund.
4. Shipping
Shipping is available only when explicitly stated in the individual lot description.
When shipping is offered, the buyer’s registered Hibid credit card will be charged for:

Harris Real Estate & Auction is not responsible for packages lost, damaged, or missing after transfer to the carrier.
Insurance claims must be filed directly by the buyer with the carrier.
Buyers are responsible for ensuring their Hibid shipping address is accurate before the auction ends.
5. Sales Tax & Exemption
Applicable sales tax will be collected unless a valid tax exemption form is submitted.
Exemption forms must be emailed to online@harrisauctions.com before the auction closes.
A new form is required for each auction event.
6. Property Condition & Inspection
All items are sold “AS IS, WHERE IS,” with no warranties or guarantees of any kind.
Descriptions and photos are provided in good faith but are not guaranteed for accuracy or completeness.
It is the bidder’s responsibility to inspect items in person or thoroughly review photos and descriptions.
Placing a bid indicates full satisfaction with the item’s condition.
7. Bidding Process & Auction Closing
All bidders must be 18 years or older with an active Hibid account and a valid credit card.
Any bid placed within 2 minutes of a lot’s scheduled close will extend bidding for that lot by 2 additional minutes.
Outbid notifications may be sent by email; however, Harris Real Estate & Auction is not responsible for email delays.
Bidders are encouraged to monitor the auction closing or place maximum bids.
All bidding increments are controlled by the auction software.
8. Default & Collection
A bidder is considered in default if purchases are not paid for and removed by the stated deadline.
Defaulting bidders may be blocked from future auctions and unpaid items may be offered to the next highest bidder.
The bidder agrees to pay all attorney’s fees, collection costs, and expenses incurred in enforcing payment.
By bidding, the bidder personally guarantees payment, even when bidding on behalf of a business or entity.
9. Limitation of Liability
Harris Real Estate & Auction’s total liability is limited to the refund of any funds paid for items not delivered at pickup.
Harris Real Estate & Auction, its owners, and its staff are not liable for consequential, incidental, or indirect damages.
10. Bidder Responsibilities & Conduct
Bidders are responsible for maintaining the confidentiality of their username and password and for all activity under their account.
Offensive or inappropriate usernames may be removed or altered.
Bidders must comply with all local, state, and federal laws.
By registering and bidding, bidders authorize Harris Real Estate & Auction to charge their registered credit card for purchases and fees.
Bidders waive the right to a jury trial, agreeing that disputes will be resolved before a judge in a court of competent jurisdiction.
11. Acknowledgment
By registering, bidding, or participating in any auction event, you acknowledge that you have read, understand, and agree to all Terms & Conditions stated herein.
