1. BUYER’S PREMIUM & PAYMENT TERMS
A 20% Buyer’s Premium will be added to all winning bids to determine the final purchase price.
Unless prior arrangements are made, the credit card on file with HiBid will be automatically charged at the close of the auction.
Alternative payment methods including cash, wire transfer, cashier’s check, or money order may only be accepted if approved prior to auction closing.
Credit Card Limits & Requirements
- Invoices over $500 paid by credit card require buyer verification.
- Buyers must provide a copy of their driver’s license and written authorization prior to processing.
- Invoices exceeding $1,500 must be paid by wire transfer. Credit cards will not be accepted for balances over $1,500.
- A 3% processing fee applies to all credit card transactions.
- A $25 wire transfer fee applies to all incoming wire payments.
Payment Deadline
All invoices must be paid in full prior to item removal and by the pickup deadline stated in the auction advertisement.
No-Show / Non-Payment
A $25 no-show fee may be charged for invoices not paid by the designated pickup deadline.
Final Sale
All sales are final. No refunds, returns, or exchanges.
2. AUCTIONEER’S RIGHTS & DISCRETION
- Harris Real Estate & Auction reserves the right to add, delete, edit, combine, subdivide, or re-catalog lots at any time prior to auction closing.
- Auction dates, times, and details may be modified due to technical issues, weather conditions, or emergencies.
- The auctioneer reserves the right to accept or reject any bid.
- Employees and associates of Harris Real Estate & Auction may bid personally or on behalf of absentee/proxy bidders.
- All accepted bids constitute a legally binding contract between bidder and seller.
- All lots are sold subject to seller confirmation unless specifically advertised as Absolute.
3. PICKUP, LOADING & REMOVAL
- All purchases must be paid in full before removal.
- Items must be picked up during the stated pickup times.
- Buyers are solely responsible for dismantling, loading, securing, transporting, and unloading purchased items.
- Harris Real Estate & Auction does not provide loading assistance unless otherwise stated.
- Buyers assume all risk and liability associated with item removal.
- Buyers must verify all items prior to leaving the pickup site. Items left behind shall be considered abandoned without refund.
4. SHIPPING TERMS
- Shipping is available only when specifically stated in the lot description.
- Buyers will be charged actual shipping costs, insurance, and a $6.99 handling fee.
- Harris Real Estate & Auction is not responsible for lost, stolen, or damaged packages once shipped.
- Buyers are responsible for filing any insurance claims directly with the carrier.
- Buyers must ensure their HiBid shipping address is current and accurate prior to auction closing.
5. SALES TAX & EXEMPTION
Applicable sales tax will be collected unless a valid exemption certificate is submitted prior to auction closing.

A separate exemption form is required for each auction event.
6. PROPERTY CONDITION & INSPECTION
All items are sold “AS IS, WHERE IS” with no warranties or guarantees, expressed or implied.
Descriptions, photographs, and information are believed to be accurate but are provided for informational purposes only. Harris Real Estate & Auction makes no guarantees regarding condition, authenticity, completeness, or suitability.
Bidders are strongly encouraged to inspect items prior to bidding. By placing a bid, the bidder acknowledges satisfaction with the condition of the item.
7. BIDDING PROCESS & AUCTION CLOSING
- All bidders must be at least 18 years of age and maintain an active HiBid account with a valid credit card.
- Any bid placed within two (2) minutes of a lot closing will automatically extend bidding on that lot by an additional two (2) minutes.
- Outbid notifications may be sent via email; however, Harris Real Estate & Auction is not responsible for delayed or failed notifications.
- Bidders are encouraged to monitor auction closings or utilize maximum bidding features.
- Bid increments are automatically determined by the auction platform.
8. DEFAULT & COLLECTION
- Failure to pay for and remove purchases by the stated deadline constitutes default.
- Defaulting bidders may be suspended or permanently banned from future auctions.
- Unpaid items may be resold or offered to the next highest bidder.
- The bidder agrees to pay all attorney fees, collection costs, and expenses incurred in enforcing payment obligations.
- Individuals bidding on behalf of a company or entity personally guarantee payment and performance.
9. LIABILITY LIMITATION
Harris Real Estate & Auction’s total liability shall be limited to the return of funds paid for undelivered items.
Harris Real Estate & Auction and its representatives shall not be liable for consequential, incidental, indirect, or special damages arising from participation in the auction.
10. BIDDER RESPONSIBILITIES & CONDUCT
- Bidders are responsible for maintaining the confidentiality of their HiBid login credentials.
- Harris Real Estate & Auction reserves the right to alter or remove offensive usernames.
- Bidders agree to comply with all applicable local, state, and federal laws.
- By registering and bidding, bidders authorize Harris Real Estate & Auction to charge the credit card on file for purchases and related fees.
- Bidders waive the right to a jury trial and agree that disputes shall be resolved before a judge in a court of competent jurisdiction.
