Buyer’s Premium & Payment Terms

A 20% Buyer’s Premium will be added to all winning bids to determine the final purchase price. Unless prior arrangements have been made, the credit card on file with HiBid will be automatically charged at the conclusion of the auction. Alternative payment methods, including cash, wire transfer, cashier’s check, or money order, may be accepted only if approved before the auction closes. Invoices exceeding $500 that are paid by credit card require buyer verification, including a copy of the buyer’s driver’s license and written authorization to process the card. Invoices over $1,500 must be paid by wire transfer and are not eligible for credit card payment. A 3% processing fee applies to all credit card transactions, and a $25 fee applies to all wire transfers. All invoices must be paid in full before items may be removed and by the deadline stated in the auction advertisement. A $25 no-show fee may be assessed if payment is not received by the designated pickup deadline. All sales are final with no refunds, returns, or exchanges.

Auctioneer’s Rights & Discretion

Harris Real Estate & Auction reserves the right to add, delete, edit, combine, subdivide, or re-catalog lots at any time before the auction closes. The auctioneer may modify auction dates, times, or details due to technical issues, weather events, or emergencies. The auctioneer reserves the right to accept or reject any bid for any reason. Employees and associates of Harris Real Estate & Auction may bid for themselves or on behalf of absentee or proxy bidders. All accepted bids constitute a legally binding contract between the bidder and the seller. Unless specifically advertised as an absolute auction, all lots are sold subject to seller confirmation.

Pickup, Loading & Removal

All purchased items must be paid in full before pickup. Buyers are required to remove items during the date and time specified in the auction details. Buyers are solely responsible for the rigging, dismantling, loading, securing, transporting, and unloading of their purchases. Harris Real Estate & Auction does not provide labor or equipment for loading and assumes no liability for injuries, damages, or losses incurred during removal. Buyers must verify that all purchased items are present before leaving the pickup location, as any items left behind will be considered abandoned and forfeited without refund.

Shipping

Shipping is available only when specifically stated in the lot description. When offered, the buyer’s registered HiBid credit card will be charged for shipping costs, insurance, and a $6.99 handling fee. Harris Real Estate & Auction is not responsible for packages that are lost, damaged, or missing once they are in transit. Buyers are responsible for filing any insurance claims directly with the carrier and must ensure their shipping address on HiBid is accurate and current before the auction closes.

Sales Tax & Exemption

Applicable sales tax will be collected unless a valid exemption certificate has been provided. To claim an exemption, bidders must email a completed exemption form to online@harrisauctions.com before the auction closes. A separate exemption form must be submitted for each auction event.

Property Condition & Inspection

All items are sold “AS IS, WHERE IS” with no warranties or guarantees, either expressed or implied. Descriptions and photographs are provided in good faith; however, Harris Real Estate & Auction makes no representations regarding accuracy, completeness, or condition. It is the bidder’s responsibility to inspect items in person or carefully review all photos and descriptions before bidding. By placing a bid, the bidder acknowledges satisfaction with the condition of the item and accepts all responsibility for their purchase.

Bidding Process & Auction Closing

All bidders must be at least 18 years of age and maintain an active HiBid account with a valid credit card. Any bid placed within two minutes of a lot’s scheduled closing time will automatically extend bidding on that lot by an additional two minutes to ensure fair competition. While bidders may receive outbid notifications via email, Harris Real Estate & Auction is not responsible for delays or failures in email delivery. Bidders are encouraged to monitor the auction closing or utilize maximum bidding features to ensure participation. Bid increments are established automatically by the auction software.

Default & Collection

If purchases are not paid for and removed by the specified deadline, the bidder will be considered in default. Defaulting bidders may be prohibited from participating in future auctions, and unpaid items may be offered to the next highest bidder. The bidder agrees to pay all reasonable attorney fees, collection costs, and expenses incurred in enforcing payment. By bidding, the bidder personally guarantees payment and performance, even when bidding on behalf of a business or other entity.

Liability Limitation

Harris Real Estate & Auction’s total liability shall be limited to the return of funds paid for items that are not delivered at pickup. Harris Real Estate & Auction and its staff shall not be liable for any consequential, incidental, special, or indirect damages arising from the auction or its operation.

Bidder Responsibilities & Conduct

Bidders are responsible for maintaining the confidentiality of their username, password, and all activity conducted under their account. Offensive or inappropriate usernames may be altered or removed at the auctioneer’s discretion. Bidders agree to comply with all applicable local, state, and federal laws. By registering and bidding, bidders authorize Harris Real Estate & Auction to charge their registered credit card for purchases and applicable fees. Bidders further waive their right to a jury trial and agree that any disputes shall be resolved before a judge in a court of competent jurisdiction.

Acknowledgment

By registering, bidding, or attending any Harris Real Estate & Auction event, participants acknowledge that they have read, understand, and agree to be bound by all Terms & Conditions set forth herein.
