TERMS AND CONDITIONS

Buyer’s Premium & Payment Terms

A 20% Buyer’s Premium will be added to all winning bids to determine the final purchase price.

Unless prior arrangements are made, the credit card on file with HiBid will be charged automatically at the close of the auction. Alternative payment methods including cash, wire transfer, cashier’s check, or money order must be approved prior to auction close.

Invoices over $500 paid by credit card require buyer verification, including a copy of the buyer’s driver’s license and written authorization to process the card. Invoices exceeding $1,500 must be paid by wire transfer. Credit cards will not be accepted for balances over $1,500.

A 3% processing fee applies to all credit card payments. A $25 wire transfer fee applies to all wire payments.

All invoices must be paid in full prior to item removal and by the pickup deadline stated in the auction advertisement. A $25 no-show/non-payment fee may apply. All sales are final with no refunds or exchanges.

Auctioneer’s Rights & Discretion

Harris Real Estate & Auction reserves the right to add, delete, combine, subdivide, or edit lots prior to auction close. The auctioneer may modify sale dates, times, or details due to technical issues, weather, or emergencies.

The auctioneer reserves the right to reject or accept any bid. Harris Real Estate & Auction employees and associates may bid for themselves or on behalf of absentee bidders.

All accepted bids constitute a legally binding contract between the bidder and seller. Lots are sold subject to seller confirmation unless otherwise announced as absolute.

Pickup, Loading & Removal

All purchases must be paid in full before pickup. Buyers must remove items during the stated pickup times.

Buyers are solely responsible for dismantling, loading, securing, transporting, and unloading purchased items. Harris Real Estate & Auction does not provide loading assistance and assumes no liability for injury or damages during removal.

Items left behind after pickup are considered abandoned without refund. Buyers should verify all items before leaving the pickup location.

Shipping

Shipping is available only when specifically stated in the lot description. Buyers utilizing shipping authorize Harris Real Estate & Auction to charge the registered HiBid card for shipping, insurance, and a $6.99 handling fee.

Harris Real Estate & Auction is not responsible for packages once shipped. Buyers are responsible for filing any insurance claims with the carrier.

Sales Tax

Applicable sales tax will be collected unless a valid exemption form is submitted prior to auction close. Exemption forms must be emailed to online@harrisauctions.com for each auction event.

Property Condition & Inspection

All items are sold “AS IS, WHERE IS” with no warranties or guarantees expressed or implied. Descriptions and photographs are believed accurate but are provided for informational purposes only.

Bidders are encouraged to inspect items personally and review all photos and descriptions before bidding. By placing a bid, the bidder acknowledges satisfaction with the condition of the item.

Bidding Process

All bidders must be 18 years of age or older with a valid HiBid account and credit card on file.

Any bid placed within two (2) minutes of the scheduled closing time will extend bidding for that lot by an additional two (2) minutes.

Bidders are encouraged to place maximum bids and monitor auction closings. Bid increments are controlled automatically by the auction platform.

Default & Collection

Failure to pay for and remove purchases by the specified deadline constitutes default. Defaulting bidders may be banned from future auctions, and unpaid items may be resold.

The bidder agrees to pay all attorney fees, collection costs, and related expenses incurred in enforcing payment obligations.

Liability Limitation

Harris Real Estate & Auction’s liability is limited to the return of funds paid for items not delivered. Harris Real Estate & Auction is not liable for consequential, incidental, or indirect damages arising from the auction.

Acknowledgment

By registering, bidding, or attending this auction, all bidders acknowledge they have read, understand, and agree to all Terms & Conditions of the sale.
