BUYER’S PREMIUM & PAYMENT TERMS

A 15% Buyer’s Premium will be added to all winning bids to determine the final purchase price. Unless prior arrangements are made, the credit card on file with HiBid will be charged automatically at the close of the auction.

Accepted alternative payment methods with prior approval include:

• Cash
• Wire Transfer
• Cashier’s Check
• Money Order

Invoices over $500 paid by credit card require buyer verification, including a copy of the buyer’s driver’s license and written authorization prior to processing. Invoices exceeding $1,500 must be paid by wire transfer. A 3% credit card processing fee applies to all card transactions. A $25 wire transfer fee applies to all wire payments.

All invoices must be paid in full prior to item removal and by the deadline stated in the auction advertisement. A $25 no-show/non-payment fee may apply for unpaid invoices after pickup deadlines. All sales are final with no refunds or exchanges.

AUCTIONEER’S RIGHTS

Harris Real Estate & Auction reserves the right to add, delete, edit, combine, subdivide, or re-catalog lots at any time prior to auction close. The auctioneer may also modify sale dates, times, or details due to technical difficulties, weather, or emergencies.

The auctioneer reserves the right to accept or reject any bid. Employees, associates, and representatives of Harris Real Estate & Auction may bid personally or on behalf of absentee/proxy bidders. All accepted bids constitute a legally binding contract between the bidder and seller. Unless specifically stated otherwise, all lots are sold subject to seller confirmation.

PICKUP, LOADING & REMOVAL

Items must be paid for in full prior to pickup and removed during the scheduled pickup times listed in the auction advertisement.

Buyers are solely responsible for all loading, dismantling, rigging, securing, transportation, and unloading of purchased items. Harris Real Estate & Auction does not provide loading assistance and assumes no liability for accidents, injuries, damages, or losses during removal.

Items left beyond the stated pickup deadline may be considered abandoned and forfeited without refund. Buyers should verify all items are received before leaving the pickup location.

SHIPPING TERMS

Shipping is available only when specifically stated in the individual lot description. When offered, the buyer’s registered HiBid credit card will be charged for shipping, insurance, and a $6.99 handling fee.

Harris Real Estate & Auction is not responsible for packages lost or damaged during transit. Buyers are responsible for filing any shipping insurance claims directly with the carrier and ensuring their shipping address is current and accurate prior to auction close.

SALES TAX

Applicable sales tax will be collected unless a valid exemption certificate is provided prior to the close of the auction. A separate exemption form must be submitted for each auction event and emailed to online@harrisauctions.com before bidding closes.

PROPERTY CONDITION & INSPECTION

All property sells “AS IS, WHERE IS” with no warranties or guarantees expressed or implied. Descriptions, photos, and information are believed accurate but are provided for informational purposes only.

It is the bidder’s responsibility to inspect items and determine condition prior to bidding. By placing a bid, the bidder acknowledges satisfaction with the condition and description of the property.

BIDDING PROCESS

All bidders must be at least 18 years of age and maintain a valid HiBid account with an active credit card on file.

Any bid placed within two (2) minutes of the scheduled closing time will automatically extend bidding for that lot by an additional two (2) minutes. Bid notifications may be delayed, and bidders are encouraged to monitor the auction closely or place maximum bids in advance. Bid increments are controlled automatically by the auction software.

DEFAULT & COLLECTION

Failure to pay for or remove purchased items by the stated deadline constitutes default. Defaulting bidders may be blocked from future auctions, and unpaid items may be offered to backup bidders.

Buyers agree to pay all attorney fees, collection costs, and related expenses incurred in the enforcement of payment. By bidding, bidders personally guarantee payment and performance, including when bidding on behalf of a business or entity.

LIABILITY DISCLAIMER

Harris Real Estate & Auction’s total liability is limited to the return of funds paid for items not delivered at pickup. Harris Real Estate & Auction and its staff shall not be liable for consequential, incidental, or indirect damages related to the auction or participation therein.

BIDDER RESPONSIBILITIES

Bidders are responsible for maintaining the confidentiality of their account information and for all activity associated with their account. Offensive usernames may be altered or removed.

By registering and bidding, bidders authorize Harris Real Estate & Auction to charge their registered payment method for purchases and associated fees. Bidders also waive the right to a jury trial and agree that disputes shall be resolved in a court of competent jurisdiction.

ACKNOWLEDGMENT

By registering, bidding, or attending any Harris Real Estate & Auction event, all participants acknowledge they have read, understood, and agreed to these Terms & Conditions.
