TERMS AND CONDITIONS

BUYER’S PREMIUM & PAYMENT
A 20% Buyer’s Premium is added to all winning bids. All invoices must be paid in full before pickup and by the deadline listed in the auction details. Accepted payments: Cash, Wire Transfer, Cashier’s Check, Money Order, and Credit Card (3% fee). Invoices over $2,000 cannot be paid by credit card. Unless arranged otherwise, the Hibid-registered card will be charged automatically after the auction. A $25 No-Show Fee may apply if payment is not received by the pickup deadline. All sales are final.

AUCTIONEER’S RIGHTS
Harris Real Estate & Auction may add, delete, combine, or edit lots at any time and may modify sale dates due to technical issues, weather, or emergencies. We reserve the right to accept or reject any bid. Employees may bid. All lots sell subject to seller confirmation unless advertised as absolute.

PICKUP, LOADING & REMOVAL
Items must be paid in full before pickup and removed during the posted pickup time. Buyers are responsible for all loading, rigging, securing, and hauling. No loading assistance is provided. Harris Real Estate & Auction is not liable for injuries or damages during removal. Items left on-site after pickup are considered abandoned without refund.

SHIPPING
Shipping is offered only when stated on a specific lot. When available, the buyer’s Hibid credit card will be charged for shipping, insurance, and a $6.99 handling fee. Harris Real Estate & Auction is not responsible for packages lost or damaged in transit. Buyers must file insurance claims directly with the carrier and ensure their Hibid shipping address is correct.

SALES TAX & EXEMPTION
Sales tax will be collected unless a valid exemption form is submitted before auction close to:

A separate form is required for each auction.

PROPERTY CONDITION
All items sell “AS IS, WHERE IS” without warranties of any kind. Descriptions and photos are provided in good faith but not guaranteed. Buyers are responsible for inspecting items or reviewing photos before bidding. Placing a bid indicates full satisfaction with the item’s condition.

BIDDING & AUCTION CLOSING
Bidders must be 18+ and maintain an active Hibid account. Any bid placed within the final 2 minutes extends bidding on that lot by 2 additional minutes. Email notifications may occur but are not guaranteed. Bidders are encouraged to watch the auction close and/or place maximum bids. Bidding increments are set by the auction software.

DEFAULT & COLLECTION
Unpaid or unremoved purchases are considered in default. Defaulting bidders may be blocked from future auctions, and items may be offered to the next highest bidder. Bidders agree to pay attorney fees, collection costs, and enforcement expenses. All bidders personally guarantee payment, including when bidding on behalf of a business.

LIMITATION OF LIABILITY
Harris Real Estate & Auction’s liability is limited to a refund of any funds paid for items not delivered at pickup. We are not liable for incidental, consequential, or indirect damages.

BIDDER RESPONSIBILITIES
Bidders are responsible for safeguarding their Hibid username and password. Offensive usernames may be removed. Bidders must comply with all applicable laws. By bidding, the bidder authorizes charges to the registered credit card and waives the right to a jury trial.
