If a key, title, VIN, Hours or any other important information is known, it will be provided in description, otherwise it is selling AS IS.
1. Payment / Buyer’s Premium
Buyer’s Premium: A 20% buyer’s premium will be added to the final bid price to determine the final selling price.
Payment Terms: All Hibid-registered credit cards will be charged automatically after the auction closes unless the buyer contacts us beforehand to arrange alternative payment.
Credit Card Fee: A 3% card fee applies to all credit card purchases.
Accepted Payment Methods: Cash, Wire Transfer, Cashier’s Check, Money Order, and Credit Cards.
Final Sale: All sales are final. No returns, refunds, or adjustments. Payment must be made prior to item removal.
2. Load Out / Pickup
Pickup Responsibility: Buyers must ensure all purchased items are accounted for before leaving the pickup site.
Pickup Requirements: Items must be picked up on the designated date, and only after full payment is received.
Rigging & Loading: Buyers are responsible for dismantling, rigging, loading, and transporting their purchases without assistance from Harris Real Estate & Auction.
Liability: Buyers assume all risk and liability for item removal and transport.
3. Tax Exemption
Exempt Bidders: Tax-exempt buyers must email documentation to online@harrisauctions.com before the auction ends. A separate form is required for each auction.
4. Shipping
Availability: Shipping is offered only on items explicitly marked “Shipping Available” in the lot description.
Fees: Hibid cards will be charged for shipping, insurance, and a $6.99 handling fee per shipment.
Risk: Harris Real Estate & Auction is not responsible for lost, broken, or damaged packages. Insurance claims are the buyer’s responsibility.
Address Accuracy: Buyers must ensure their Hibid shipping address is correct.
5. Lot Condition
No Guarantees: All items are sold As-Is, Where-Is. Descriptions are made in good faith but are not guaranteed.
Inspection Responsibility: Buyers should inspect lots in person or online prior to bidding.
No Refunds: There are no warranties, returns, or guarantees of any kind.
6. Auction Closing
Auto-Extend: Any bid placed within the last 2 minutes of closing will extend that lot’s time by 2 minutes.
Notifications: Outbid emails may be delayed. Max bids are recommended.
Bidding Increments: Set by the system and vary by auction.
7. Credit Card Policy
Required: A valid credit card is required to register.
Authorization: By registering, bidders authorize Harris Real Estate & Auction to charge the card on file for all purchases.
No-Show Fee: A $25 fee may be charged for unpaid accounts after the posted pickup deadline.
Limitations: Credit cards will not be accepted for purchases over $2,000.
8. Auctioneer’s Discretion
Modifications: Harris Real Estate & Auction reserves the right to change auction dates/times, or remove/re-catalog items due to emergencies or technical issues.
Right to Refuse: Bids may be rejected for any reason.
Legal Obligation: All accepted bids are binding legal contracts.
Liability Waiver: Bidders agree to hold Harris Real Estate & Auction harmless for payment defaults or resale of unpaid items.
9. Seller Confirmation

Unpaid Accounts: Bidders who fail to settle by the pickup deadline will be considered in default and may be banned from future auctions.
Resale of Items: Unpaid items may be offered to the next highest bidder.
Legal Costs: Bidders are responsible for any attorney or collection fees resulting from nonpayment.
14. Limitation of Liability
Harris Real Estate & Auction’s Liability: Limited solely to refunding payments for undelivered items at the time of pickup.
15. Legal Venue
Disputes: Any legal dispute will be resolved in a court with proper jurisdiction in the state where the auction is conducted.
