TERMS AND CONDITIONS

A 20% Buyer’s Premium will be added to all winning bids to determine the final purchase price.

PAYMENT TERMS: Unless prior arrangements have been made and approved by Harris Real Estate & Auction before auction close, the credit card on file with HiBid will be automatically charged following the conclusion of the auction. Alternative payment methods including cash, wire transfer, cashier’s check, or money order may be accepted only if approved in advance. A 3% processing fee applies to all credit card transactions. Invoices exceeding $500 paid by credit card require buyer verification. Buyers must provide a copy of their driver’s license and written authorization before the credit card will be processed. Invoices exceeding $1,500 must be paid by wire transfer and will not be accepted by credit card. A $25 wire transfer fee will be added to all wire payments. All invoices must be paid in full prior to item removal and by the date specified in the auction advertisement. A $25 no-show fee may be charged if payment is not received by the designated pickup deadline. All sales are final with no refunds, returns, or exchanges.

AUCTIONEER’S RIGHTS: Harris Real Estate & Auction reserves the right to add, delete, edit, combine, subdivide, withdraw, or re-catalog lots at any time prior to auction close. The auctioneer may modify sale dates, times, or auction details due to technical issues, weather events, emergencies, or circumstances beyond its control. Harris Real Estate & Auction reserves the right to accept or reject any bid for any reason and shall have sole discretion in resolving any bidding disputes. Employees and associates of Harris Real Estate & Auction may bid for themselves or on behalf of absentee or proxy bidders. All accepted bids constitute a legally binding contract between the bidder and seller. All lots are sold subject to seller confirmation unless specifically advertised as an Absolute Auction.

PICKUP, LOADING & REMOVAL: Purchased items must be paid in full prior to pickup. Buyers must remove all purchases during the designated pickup date and time stated in the auction advertisement. Buyers are solely responsible for all labor, dismantling, rigging, loading, securing, transportation, and unloading of purchased items. Harris Real Estate & Auction does not provide labor, tools, equipment, or loading assistance unless specifically stated and assumes no liability for injuries, damages, losses, or accidents occurring during removal. Buyers must verify all items are received prior to leaving the pickup location. Any items left behind after the pickup deadline shall be considered abandoned and forfeited without refund.

SHIPPING: Shipping is available only when specifically stated in the lot description. When shipping is offered, the buyer’s registered HiBid credit card will be charged for all shipping expenses, insurance costs, and a $6.99 handling fee. Harris Real Estate & Auction is not responsible for lost, damaged, delayed, or missing packages once they have been delivered to the carrier. Buyers are responsible for filing any insurance claims directly with the shipping carrier. Buyers must ensure their shipping address on file is current and accurate prior to auction close.

SALES TAX: Applicable sales tax will be collected unless a valid tax exemption certificate is provided. To claim exemption, buyers must submit a completed exemption form to online@harrisauctions.com prior to the close of the auction. A separate exemption form must be submitted for each auction event.

PROPERTY CONDITION & INSPECTION: All items are sold strictly AS IS, WHERE IS, with all faults and without warranties or guarantees of any kind, either expressed or implied. Descriptions, photographs, measurements, serial numbers, and representations are provided in good faith and are believed to be accurate; however, Harris Real Estate & Auction makes no warranty regarding accuracy, completeness, authenticity, age, condition, quality, fitness for a particular purpose, or merchantability. It is solely the bidder’s responsibility to inspect all items in person or otherwise satisfy themselves regarding condition prior to bidding. By placing a bid, the bidder acknowledges they have inspected the item or voluntarily waived their right to inspection and are satisfied with its condition.

BIDDING PROCEDURES: All bidders must be at least 18 years of age and maintain an active HiBid account with a valid credit card. Any bid placed within two (2) minutes of the scheduled closing time of a lot will automatically extend bidding on that lot by an additional two (2) minutes. Bidders may receive outbid notifications by email; however, Harris Real Estate & Auction assumes no responsibility for delayed, failed, or undelivered notifications. Bidders are encouraged to monitor auction closings or place maximum bids. Bid increments are established and controlled by the auction software.

DEFAULT & COLLECTION: If a bidder fails to pay for and remove purchased items within the specified time, the bidder shall be considered in default. Defaulting bidders may be suspended or permanently banned from future auctions. Unpaid items may be offered to the next highest bidder, resold, or otherwise disposed of at the auctioneer’s discretion. The defaulting bidder agrees to pay all attorney fees, court costs, collection fees, storage fees, damages, and other expenses incurred in collecting unpaid balances or enforcing these Terms & Conditions. By bidding, each bidder personally guarantees payment and performance, whether bidding individually, on behalf of a business, partnership, trust, corporation, or other entity.

LIMITATION OF LIABILITY: Harris Real Estate & Auction’s maximum liability shall be limited solely to the return of funds actually paid by the buyer for any item not delivered. Under no circumstances shall Harris Real Estate & Auction, its employees, agents, sellers, or affiliates be liable for consequential, incidental, indirect, punitive, or special damages arising from participation in the auction, bidding activity, item condition, removal, transportation, shipping, technical issues, or auction operations.

BIDDER RESPONSIBILITIES: Bidders are solely responsible for maintaining the confidentiality of their username, password, and account information and are responsible for all bidding activity conducted under their account. Offensive, misleading, fraudulent, or inappropriate usernames may be modified or removed at the auctioneer’s discretion. Bidders agree to comply with all applicable federal, state, and local laws. By registering and bidding, bidders authorize Harris Real Estate & Auction to charge the credit card on file for purchases, buyer’s premiums, processing fees, shipping charges, handling fees, taxes, and other applicable charges. Bidders knowingly waive any right to a jury trial and agree that any dispute arising from the auction shall be resolved before a judge in a court of competent jurisdiction.
